Terms of service

1.The agreement

These terms are a contract between you and PKJMB MEDIA PRIVATE LIMITED (“Pinnakle”, “we”). By creating a workspace, signing in or using Pinnakle OS you accept them. If you accept for an agency, you confirm you may bind it. If you do not agree, do not use the service. The Privacy policy, Refund & cancellation policy and Data processing summary form part of this agreement.

2.The service

Pinnakle OS is a web application for running a video or content agency: work boards, calendars, chat, client portals, reports and related tools. We improve it continuously, so features change. We aim for high availability but do not promise the service will be uninterrupted or error-free. Roles matter: the workspace owner controls who is invited and what each person can see.

3.Accounts and workspaces

• You must give accurate information and keep your sign-in details to yourself. You are responsible for what happens under your account.
• The person who creates a workspace is its owner. Owners are responsible for their team and their clients’ use of the workspace.
• You must be 18 or older, or have a parent or guardian’s consent, and be able to form a binding contract under Indian law.

4.Plans, the free trial and auto-renewal

• Solo is free. Paid plans (Starter, Studio, Agency) are subscriptions billed monthly or annually, at the prices on our pricing page when you subscribe.
• 14-day trial: a new workspace starts with 14 days of the Studio plan, no card needed. If you do not pick a plan, the workspace is read-only for 3 days and then paused until you choose one (Solo is free); nothing is deleted.
• Auto-renewal: a paid subscription renews automatically at the end of each billing period at the then-current price (or your launch price while it applies) until you cancel. By subscribing you authorise Razorpay to charge your chosen payment method on each renewal. We email you before an annual renewal.
• Cancel any time from Billing & plan. See the Refund & cancellation policy for what happens to the current period.
• Price changes: we give at least 30 days’ notice by email before a price change reaches your renewal.
• Credit packs for AI features are bought separately and are described in the refund policy.

5.Taxes (GST)

Prices for customers in India are shown without GST. GST at 18% (or the rate then in force) is added at checkout and shown on the tax invoice, which carries our GSTIN (29AAOCP3357L1ZO). Give us your GSTIN at checkout if you want to claim input credit. Customers outside India pay in US dollars; any local taxes or duties are theirs unless the law says we must collect them.

6.Acceptable use

You will not, and will not let anyone you invite:

• break any law, or upload content you have no right to use, or that is defamatory, obscene, hateful or infringes someone’s rights;
• try to reach another workspace’s data, probe or attack the service, or bypass limits, seats or billing;
• send spam or run phishing, malware or deceptive campaigns through the service;
• reverse engineer the software, or resell it except under a white-label plan that allows it;
• put in sensitive data the service is not built for (for example card numbers or government ID numbers in free-text fields).

We may suspend or remove content or a workspace that breaks these rules, with notice where we reasonably can.

7.Your content and our software (IP)

Yours: everything your agency adds stays yours. You give us a limited licence to host, copy, display and process it only to provide the service to you, including sending selected text to AI model providers when you use an AI feature. You promise you have the rights to do this.

Ours: the software, design, brand and documentation belong to Pinnakle and its licensors. You get a non-exclusive, non-transferable right to use them while your subscription (or free plan) lasts. Feedback you give us may be used without obligation.

8.Third-party tools

The service connects to tools you choose (for example Slack, WhatsApp, Gmail, Google Sheets, Zapier, Instantly). Their names and logos belong to their owners and are used only to name what you connect. Those tools have their own terms, and we are not responsible for them.

9.Suspension and ending

You can stop using the service or delete your workspace at any time. We may suspend or end access for non-payment (after the grace period shown in the app), breach of these terms, or legal requirement. After a workspace ends, we keep a downloadable export available for 30 days on request, then delete data as described in the Privacy policy.

10.No warranty

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. AI features can be wrong; check their output before you rely on it or send it to a client.

11.Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data. Our total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the event that gave rise to the claim (or ₹10,000 if you are on a free plan). Nothing in these terms limits liability that cannot be limited by law, including for fraud.

12.Indemnity

You will cover our reasonable losses and costs from a third-party claim caused by your content or your breach of these terms.

13.Governing law and disputes

These terms are governed by the laws of India. We will first try to settle any dispute by talking: write to pinnaklemedia@gmail.com. If that fails, the the courts at Bengaluru, Karnataka have exclusive jurisdiction.

14.Changes to these terms

We may update these terms. For changes that matter we will email workspace owners at least 14 days before they apply. Continuing to use the service after that date means you accept them.
